  5. Chapter 12.1-06.1-08 Computer fraud-computer crime- 
  6. Classification- Penalty.

  8. 1. A person commits computer fraud by gaining or attempting to 
  9. gain access to, altering, damaging, modifying, copying, 
  10. disclosing, taking possession of, or destroying any computer, 
  11. computer system, computer network, or nay part of such computer, 
  12. system or network, without authorization, and with the intent to 
  13. devise or execute any scheme or artifice to defraud, deceive, 
  14. prevent the authorize use of, or control property or services by 
  15. means of false or fraudulent pretenses, representations, or 
  16. promises. A person who commits computer fraud is guilty of a 
  17. class C felony.

  19. 2. A person commits computer crime by intentionally and either in 
  20. excess of authorization given or without authorization, gaining 
  21. or attempting to gain access to, altering, damaging, modifying, 
  22. copying, disclosing, taking possession of, destroying, or 
  23. preventing the authorized use of any computer, computer system, 
  24. or computer network, or any computer software, program, or data 
  25. contained in such computer, computer system, or computer network. 
  26. A person who commits computer crime is guilty of a class A 
  27. misdemeanor.
